01Agreement

These Terms of Service ("Terms") govern your access to and use of the PostZeno email delivery service ("Service") provided by PostZeno ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.

02Your Account

• You must provide a valid email address and create a password of at least 6 characters.
• You are responsible for keeping your credentials and API keys confidential.
• You are responsible for all activity that occurs under your account, including activity initiated by API keys you have created.
• Notify us immediately at [email protected] if you believe your account has been compromised.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

03Acceptable Use

You may use the Service to send legitimate transactional and marketing email only when you:

• Have explicit consent from each recipient to email them, OR an existing business relationship that constitutes lawful basis under applicable anti-spam law
• Include a clear sender identification and a working unsubscribe mechanism in marketing messages
• Honor unsubscribe requests within 10 business days
• Send only from domains you own or are authorized to send from
• Maintain bounce rates below 5% and complaint rates below 0.1%

04Prohibited Content & Behavior

You may NOT use the Service to send:

• Unsolicited bulk email (spam) in any form
• Phishing, smishing, or any content that impersonates another person or entity
• Malware, viruses, or links to malicious software
• Content promoting illegal goods or services, including narcotics, weapons, counterfeit currency, or stolen credentials
• Sexually explicit material involving minors, content that sexualizes minors in any way
• Content that incites violence or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Content that violates intellectual property rights of others
• Pyramid schemes, multi-level marketing schemes that misrepresent earning potential, or other deceptive financial schemes
• Content related to gambling where prohibited by the recipient's jurisdiction
• Pharmaceutical advertisements where prohibited

You may NOT:

• Reverse-engineer, decompile, or attempt to discover the source code of the Service
• Bypass rate limits, send through unauthorized channels, or share API keys publicly
• Use harvested, scraped, or purchased mailing lists
• Attempt to disrupt the Service through DDoS, fuzzing, or excessive automated requests beyond your plan limits
• Resell the Service without a written reseller agreement

05Payment Terms

• Paid plans are sold as one-time prepaid credit packs in US Dollars (USD).
• Payment is processed by a third-party payment processor. By purchasing, you agree to that processor's terms in addition to these Terms.
• Credits are added to your account upon successful payment confirmation, typically within minutes.
• Credits do not expire while your account remains active. If your account is deleted (by you or due to violations), unused credits are forfeited.
• Refunds are governed by our Refund Policy.

06Intellectual Property

The Service, including software, designs, logos, and documentation, is the property of PostZeno and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of these Terms.

You retain all rights to email content you submit. You grant us only the rights necessary to deliver and operate the Service, such as queuing, scanning for malware, and producing aggregate analytics.

07Disclaimers & Limitation of Liability

The Service is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, PostZeno's total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, even if advised of the possibility.

We do not guarantee that any specific email will reach a recipient's inbox; deliverability depends on factors including recipient mail server policies, sender reputation, and content.

08Termination

• You may terminate your account at any time from the dashboard.
• We may suspend or terminate your account if you breach these Terms, engage in prohibited behavior, or if required by law.
• Upon termination, your access to the Service ends immediately. We will delete or anonymize your data per our Privacy Policy retention schedule.

09Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.

Any dispute arising from these Terms shall first be addressed via good-faith negotiation. If unresolved within 60 days, disputes shall be submitted to binding arbitration in Delaware under the rules of the American Arbitration Association.

Customers in jurisdictions where mandatory consumer protection laws apply (e.g., EU, UK) retain rights granted by such laws notwithstanding this section.

• 营销邮件中包含清晰的发件人识别和有效的取消订阅机制
• 在 10 个工作日内处理取消订阅请求
• 仅使用您拥有或有权使用的域名发送邮件
• 退信率保持在 5% 以下，投诉率保持在 0.1% 以下

04禁止内容与行为

您 不得 通过本服务发送：

• 任何形式的未经请求的批量邮件（垃圾邮件）
• 钓鱼、短信钓鱼，或冒充他人或其他实体的内容
• 恶意软件、病毒，或指向恶意软件的链接
• 推广非法商品或服务的内容，包括毒品、武器、伪造货币、被盗凭据等
• 含有未成年人色情内容，或以任何方式将未成年人色情化的内容
• 基于种族、民族、宗教、性别、性取向、残疾或其他受保护特征煽动暴力或仇恨的内容
• 侵犯他人知识产权的内容
• 传销、虚假宣传收益的多层级营销，或其他欺诈性金融骗局
• 在收件人辖区被禁的赌博相关内容
• 在被禁辖区的处方药广告

您 不得：

• 对本服务进行逆向工程、反编译，或试图获取源代码
• 绕过速率限制、通过未授权渠道发送，或公开 API Key
• 使用爬取、抓取或购买的邮件列表
• 通过 DDoS、模糊测试或超出套餐限制的自动请求扰乱本服务
• 未签署书面经销商协议而转售本服务

05付款条款

• 付费套餐以一次性预付额度包形式出售，币种为美元（USD）。
• 支付由第三方支付服务商处理。购买即表示您同意该服务商的服务条款及本条款。
• 付款确认后，额度通常在数分钟内计入您的账户。
• 账户保持活跃期间额度永久有效。账户删除（由您或因违规）后，未使用的额度将作废。
• 退款规则详见我们的 退款政策。

06知识产权

本服务（包括软件、设计、Logo、文档）属于 PostZeno，受版权、商标及其他法律保护。我们仅授予您一项有限、非排他、不可转让的许可，在本条款有效期内将本服务用于其本意用途。

您始终保留对所提交邮件内容的全部权利。您仅向我们授予运营本服务所必需的权利，例如排队投递、恶意内容扫描和聚合性分析。

07免责声明与责任限制

本服务按 "现状" 提供，不附带任何形式的明示或默示保证，包括适销性、特定用途适用性或不侵权保证。

在法律允许的最大范围内，PostZeno 因本服务相关任何主张所承担的责任总额，以您在主张发生前 12 个月 内向我们支付的金额或 100 美元（取较高者）为上限。

我们不对间接、附带、特殊、衍生或惩罚性损害承担责任，包括利润或收入损失，即使我们已被告知可能性。

我们不保证特定邮件能够到达收件人收件箱；投递结果取决于多种因素，包括收件方邮件服务器策略、发件方信誉和邮件内容。

08终止

• 您可在控制台随时终止账户。
• 若您违反本条款、从事禁止行为，或法律要求时，我们可暂停或终止您的账户。
• 终止后您对本服务的访问立即停止。我们将依据《隐私政策》的保留期限删除或匿名化您的数据。

09适用法律与争议解决

本条款适用美国特拉华州法律，不考虑法律冲突原则。

因本条款产生的任何争议应首先通过善意协商解决。若 60 天内未能解决，争议应根据美国仲裁协会规则在特拉华州进行有约束力的仲裁。

位于强制性消费者保护法适用辖区（如欧盟、英国）的客户，仍享有该等法律授予的权利，不受本条款影响。
